Haryana Notifies Conditions for Employing Women in Night Shifts in Establishments

To enable round-the-clock operations in sectors like IT, ITeS, banking, export-oriented units, logistics, warehousing, and 3-star and above hotels, the Haryana Government has notified a new set of conditions for employing women during night shifts (08:00 PM to 06:00 AM), ensuring their safety, security, and welfare. There has been a slight modification as compared to the earlier Notification released on May 8, 2025. [Conditions for Employing Women in Night Shifts in establishments – Haryana]. The current Notification supersedes all the previous Notifications.

The notification permits eligible establishments registered under the Punjab Shops and Commercial Establishments Act, 1958 to employ women at night, subject to compliance with the following conditions:

Note: Such exemption shall be valid for one year from the date of issuance of the notification.

  • Applications must be submitted online at least 2 weeks before the intended start of night shifts; exemption is granted automatically through self-certification.
  • Employers must comply with the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013, including submission of the annual return to the District Authority and the Labour Commissioner.
  • Consent from each woman employee to work night shifts (08:00 PM to 06:00 AM) must be obtained and submitted to authorities when requested.
  • Adequate lighting must be ensured inside and around the establishment, covering all areas women may access during their shift. Sufficient security personnel must be deployed.
  • Transportation must be provided from residence to workplace and back, with trained drivers, security guards (including female guards), communication channels, and safety measures like CCTV and GPS. Women may opt out of this facility with written consent.
  • Women workers must be deployed in batches of at least four. In IT/ITeS sectors, this requirement may be relaxed for senior-level women (earning above ₹1 lakh/month) who consent to work alone at night.
  • Medical facilities, including access to a doctor or female nurse, must be provided during night shifts. Alternatively, tie-ups with nearby hospitals for ambulance and emergency care are allowed. Emergency contact numbers must be displayed prominently.
  • Where accommodation is provided, it must be exclusively for women and supervised by female wardens or supervisors.
  • All other applicable provisions under the Punjab Shops and Commercial Establishments Act, 1958, and related labour laws (including Equal Remuneration Act, ESI, and Haryana Labour Welfare Fund) must be followed.
  • Employers may employ women wholly or partially during night shifts, provided all specified conditions are met.
